What is child support?
Child support is the financial assistance paid by a parent for the care and maintenance of the child. The policy of the state of California is that a parent’s principal obligation is to support his or her minor child according to the parent’s circumstances and station in life and both parents are responsible for the support of their child.
How long does child support last?
Child support generally lasts until the child turns 18 years old, or if the child is a full time high school student, until the child turns 19 or graduates high school whichever occurs first.
How is the amount of child support calculated?
California requires support be set based on the statewide uniform child support guidelines. Although the parties can agree to vary from these guidelines, support is presumed correct if it is set based on the statutory formula.
A complex calculation is used to determine the exact amount of child support. The calculation takes into account the percentage of time each parent spends with the child, the income of each parent, and other financial circumstances of the parties. A computer program is often utilized to calculate the exact figure.
Can child support be modified?
Yes. Child support can be modified if there is a change of circumstances such as a change of income, a change of custody or visitation, etc.
